Signage Terms and Conditions


Sales Policy

Bureau of Correctional Enterprises is limited by Wisconsin law to sell only to state and federal agencies, county and municipal facilities, and non-profit organizations. BCE’s market is defined by Wisconsin Statute 303.01(b). The law states that prison industries may sell its products and services to the state and its political subdivisions, tax supported institutions or nonprofit agencies, and to other states of the United States. Restrictions on the sale of individual product lines may apply.


New Customer Accounts

New accounts can only be established by registering at www.shopbce.com. Please allow adequate time for the approval process.


Acknowledgements

Every order is acknowledged with an email that connects the established BCE location/contact and designated customer contact. Please review your estimate and order acknowledgement carefully and respond in the time frame specified in the email.


Ordering

If your company requires the assignment of Purchase Order numbers, the number must be validated by a person acting as an authorized representative for the organization. Purchase Orders must be emailed to the Industries shop that is providing the product or service:

To avoid misunderstanding, please include all of the following information: Purchase order number, billing and shipping addresses, delivery requirements including contact persons and phone numbers, and product numbers with descriptions including color or finish selections when appropriate.


Changes and Cancellations

Orders entered and acknowledged cannot be changed or canceled without BCE's consent. Orders cannot be cancelled once material has been purchased or the sign or print has been made. All custom manufactured products are non-returnable and non-refundable. For product returns due to authorized user error, authorized users are responsible for all actual costs associated with the preparation of the product for shipping and all to/from shipping costs to the nearest service location.


Freight Terms

Shipping and handling charges: All items are subject to freight charges that are pre-paid by BCE, and those charges will be added to the invoice, unless noted differently on the estimate/quote. BCE reserves the right to use its own or commercial carriers for the "best way" to ship at its sole discretion.


If dock delivery is determined to be the best way, common carrier or vendor truck will be used. Unloading to be performed by the customer or carrier. Carton(s) will be deposited on inside dock of the agency facility or transported to the interior/ground floor.


If delivered and installed: The designated vendor will deliver and install. Packing and debris will be removed by the vendor and completely removed from the premises.


Redelivery of Freight

When redelivery of product is required, actual costs will be billed to the customer.


Warehouse Order Pick-Up

Orders may be picked up at a BCE warehouse with prior arrangement. No credit will be due the customer.


Shipment Damage Claims

All products are packaged to comply with carrier requirements and leave BCE factories free of damage. All shipments should, however, be inspected immediately upon receipt. Should damage occur to shipments, the delivering carrier should be requested to record any damage. Damage claims should be made directly to BCEsignsales@wisconsin.gov. A Return Authorization (RA) is required to return damaged goods. If a Return Authorization can be negotiated by phone at the time of delivery, the goods need not be received. When further damage is found after delivery, email BCEsignsales@wisconsin.gov for immediate inspection by the delivering carrier. Notification of concealed damages must be made within 5 days after delivery of merchandise. Carrier liability ceases after 5 days.


Title and Risk of Loss

For purposes of risk of loss: FOB destination is a contraction of the term "Free on Board." The term means that the buyer takes ownership of goods once the product arrives at the buyer's receiving dock. With terms of FOB shipping point ownership of the product passes to the buyer when product is loaded onto the carrier.


If you receive product that is freight damaged, the following steps must be taken:

  • 1. Before signing for the merchandise, make careful notation of all damages on the bill of lading or delivery receipt.
  • 2. Immediately contact BCE to file a claim with the delivery carrier. Request an inspection by the carrier agent.
  • 3. The claim must be filed within five (5) days of receipt of goods. Retain all shipping cartons for inspection by the carrier agent.

Unopened Shipment Damage Claims

Neither BCE nor the carrier will be responsible for concealed damage claims if shipments are left unopened. Notification of concealed damage must be made to BCE Customer Service within 5 days after delivery of merchandise. It is the customer's responsibility to inspect delivered products. Shortage Claims

Shortage claims must be reported to BCE Customer Service within 5 days after the delivery date. Late reports will not be honored.  Please email BCEsignsales@wisconsin.gov.


Storage

Scheduled deliveries held by Bureau of Correctional Enterprises beyond 15 days, as requested by the customer, will result in a storage charge. BCE will notify customers 5 days in advance of charge being assigned. Notification will include the dollar amount of current storage charge and revised removal expectations.


Installation Services

Installation services can be provided anywhere in the state. The following information must be provided with the purchase order when requesting installation of sign orders:

  • 1. Two contact persons and phone numbers
  • 2. Specific floor and room numbers
  • 3. Availability of freight elevator
  • 4. Size of elevator
  • 5. Are stairs the only access to floor location?
  • 6. Width of stairs
  • 7. Width of narrow hallways or doors
  • 8. Is area under construction?


Providing this information prior to delivery is key to a well-planned, successful installation. Occasional delivery delays may be experienced due to scheduling considerations on installed deliveries. It is the responsibility of the customer to have the job site prepared to accept BCE product. It is not the responsibility of BCE staff or designee to remove existing signs unless it is specified in the quote.


Invoicing

When shipment is considered complete an invoice is emailed to the "Bill to" email address as shown on the Order Acknowledgement. Make remittance payable to Bureau of Correctional Enterprises and send to:

Return one copy of the invoice to assure proper credit to your account.


Timely payment applies to state agency purchases from BCE according to Wisconsin Statutes 16.528(2) Interest Payable.


BCE can accept credit card payments from buyers who have registered on the BCE web site. For orders paid for by credit card a PAID Invoice will be sent to the "Bill to" address as shown on the Order Acknowledgement.


Net 30 Days

Payment on all BCE invoices shall be made in U.S. dollars within thirty (30) days of the date of each such invoice and without offset, back charges, retention, or withholding of any kind.


Returns

BCE will not permit return of materials without written consent. Contact your Sales Representative for a Return Authorization (RA) number. Returned shipments, when accepted, are subject to a handling/restocking charge, the exact amount of which will be determined after merchandise is received and inspected. All freight or express charges must be prepaid for return shipments; otherwise they will not be accepted. Customers pay all shipping charges both to and from. Orders returned without a RA will not be accepted. Customer damaged materials and items specially built to order cannot be returned under any conditions.


Governmental Agencies (Federal, State, County and Municipalities)

Outside of Wisconsin all orders are shipped Freight on Board (FOB) factory by commercial carrier with prepaid freight charges added to customer invoice.


Service Policy

All BCE products are supported by the BCE Sales and Service staff. Service, repairs and replacement parts not covered under warranty will have charges assessed. Contact sales to schedule a service appointment. Actual charges will be determined by BCE staff and authorization by the customer will be required prior to repair.


Force Majeure

The term "force majeure" means an occurrence that causes a delay beyond the control of the party affected and could not have been avoided by exercising reasonable diligence. Force majeure shall include Acts of God, war, riots, strikes, fire, floods, epidemics, or other similar occurrences. For the purposes of this contract, it shall also include institution lockdowns. If either party is delayed by force majeure, said party shall provide written notification within forty-eight (48) hours. The notification shall provide evidence of the force majeure. In the case of institution lockdowns, BCE shall provide the customer with anticipated length of time for the lockdown, a detailed report of orders for that customer in pipeline and the percent of completion for each order.


Product Pricing

PRICES LISTED IN BCE PRICE LISTS DO NOT INCLUDE SHIPPING AND HANDLING. BCE price lists and any prices contained therein are subject to change without notice. Prices applicable to all Customer orders shall be those in effect at the time BCE receives a complete order from Customer unless: Customer and BCE have in place a written special pricing or master supply agreement; which agreement specifies the prices to be paid by Customer.


Weights and Dimensions

All weights and dimensions listed in BCE's price or product listings are approximate.


Statute of Limitations

Except as specifically set forth in these Terms, Conditions, Rights and Warranties, no claim arising out of or in connection with products purchased from BCE, these Terms, Conditions, Rights and Warranties or any product warranty applicable to any BCE product may be brought by Customer more than one (1) year after the cause of action on which it is based has accrued.


Jurisdiction and Venue

The interpretation and application of these Terms, Conditions, Rights and Warranties and any product warranties applicable to products purchased by Customer from BCE shall be governed in all respects by the laws of the State of Wisconsin, U.S.A., without reference to the rules of any jurisdiction concerning conflicts of laws or the provisions of the United Nations Convention on Contracts for the International Sale of Goods. Customer agrees that all disputes arising from the interpretation or application of these Terms, Conditions, Rights and Warranties or any product warranty shall be subject to the exclusive jurisdiction of and venue in the federal and state courts located in Madison, Wisconsin, or within Dane County, Wisconsin, U.S.A.; and Customer hereby consents to the personal and exclusive jurisdiction and venue of these courts.


Product Warranties

These Terms, Conditions, Rights and Warranties may change from time to time. Purchases of products from BCE shall be subject to BCE's then current Terms, Conditions, Rights and Warranties at time of job completion.


Sign Limited Warranties

Bureau of Correctional Enterprises (BCE) sells several different sign products with various warranties. We acknowledge vendor warranties, by source manufacturer and product type, as their specifications indicate. Warranty period begins once installation begins.


As provisions may include, these warranties cover defects in materials and craftsmanship found during normal usage of the products during the warranty period. If a product is defective, and if written notice of the defect is given to BCE within the applicable warranty period, BCE, at its option, will either repair or replace the defective product with a comparable component or product or provide a refund of the purchase price. BCE reserves the right to determine the labor method used during repair or replacement of product.


The warranty does not apply to damage caused by carrier other than BCE, alterations to product not expressly authorized by BCE, nor to products considered to be of a consumable nature such as light bulbs, light ballasts and surge suppression products. If damage by a carrier other than BCE has occurred and BCE arranged for the transportation BCE will file freight claims.


If the product becomes defective, because it was not installed properly or used for its stated purpose, BCE will not be obligated to replace it.


Modifications to U.L. Listed products or failure to follow written installation or user guides voids product warranty.


Except as stated above, BCE makes no express or implied warranties as to any product and in particular makes no warranty of fitness for any particular use. At BCE’s option, product repair, replacement, or refund of purchase price is the customer’s exclusive remedy for any and all product defects.


BCE will not be liable for consequential, economic, or incidental damages arising from any product defect.


In the event that the product does not perform as warranted:


(a) Manufacturer shall be allowed to conduct an on-site inspection and investigation, or be provided digital images of defects (b) Manufacturer shall work directly with the end-user to resolve any warranty matter, (c) The sole remedy will be the repair or replacement of the defective product at the sole discretion of the Manufacturer, and/or (d) The repair or replacement by Manufacturer shall be limited to the remanufacture and shipment of the replacement or repaired product to the site of the end-user's product.


This warranty only applies to the manufacture and material used in the manufacture of the product. Manufacturer shall not be liable for any other costs, including but not limited to installation, labor or other costs or expenses. Any repair or replacement shall be warranted for a period up to the remaining life of the original warranty. Further the repair or replacement costs incurred by Manufacturer shall not exceed the purchase price paid for the product.


This warranty shall not apply to defects or damage arising from any of the following: 1. Accidents, abuse or misuse 2. Willful destruction or acts of God


No other warranties, express or implied, are made, including merchantability or fitness for a particular purpose. Under no circumstances shall manufacturer be liable for any loss or damage arising from the purchase, use or inability to use this product, or for any special, indirect, incidental, or consequential damages. No one, including but not limited to any agent or employee of manufacturer, has the authority to modify the obligations or limitations of this warranty.


This warranty gives you specific legal rights, and you may also have other rights which vary from state to state, therefore, some of the limitations stated above may not apply to you. It is to your benefit to save your documentation upon purchase of a product.
